CONSIDERACIONES ETICAS EN TORNO DEL IMPLANTE DE CORAZON ARTIFICIAL ABIOCOR

El implante de corazón artificial, como todas las tecnologías médicas de avanzada, incluye un número importante de aspectos legales, sociales y éticos. Estos nuevos avances deben estar sujetos a la consideración y evaluación a nivel individual y de la sociedad.

Resumen
El implante de corazón artificial, como todos los avances médicos tecnológicos, engloba un número de complejos aspectos legales, sociales y éticos. Desde que fue implantado el último corazón artificial AbioCor han surgido nuevas cuestiones como resultado de una demanda presentada por la viuda de un paciente, quien argumentó que tanto ella como su esposo no estaban adecuadamente informados de los riesgos y consecuencias de ese procedimiento experimental y, de esa forma, no estaban capacitados para el ofrecimiento del consentimiento informado. Este artículo analizará nuevas tendencias en el debate ético relacionado con el corazón artificial AbioCor, desde la publicación de un artículo anterior, en el que muchos de estos temas fueron inicialmente explorados. Las dos categorías bioéticas primarias definidas en el análisis son la ética de las investigaciones clínicas y la distribución ética. En estas categorías, las preguntas y preocupaciones que han aparecido como consecuencia de los estudios de investigación en fases I y II, de implante de corazón artificial, serán analizadas a la luz de los últimos descubrimientos que incluyen el quinto receptor del corazón artificial AbioCor. Los debates relacionados con el uso apropiado de dispositivos experimentales requieren no sólo la inclusión de las normativas más elevadas de protección de los derechos individuales, sino también la consideración de los temas de justicia social puestos de relieve, debido a los limitados recursos disponibles asignados para el logro de salud y bienestar.

Abstract
Artificial heart implantation, like all cutting edge medical technologies, implicates a number of complicated legal, social, and ethical issues. Since the most recent AbioCor artificial heart was implanted, new issues have arisen as a result of a lawsuit filed by a patient's widow alleging that she and her husband were not adequately informed of the risks and consequences of this experimental procedure and therefore were not able to provide informed consent. This article will review new developments in the ethical discussion regarding the AbioCor artificial since publication of an earlier article in which several of these issues were initially explored. The two primary bioethical categories addressed in this discussion are clinical research ethics and distributional ethics. Within these categories, questions and concerns that have emerged as a result of the Phase I/II research studies on artificial heart implantation will be examined in light of the latest developments involving the fifth recipient of the AbioCor artificial heart. Discussions regarding the appropriateness of experimental devices need to include not only the highest standards of protection of individual rights but also address the social justice issues raised by the limited resources currently available and assigned to improving health and well-being.
